One of the most fundamental aspects of pursuing a personal injury claim is instructing the right solicitor to represent you. However, choosing who to instruct after an accident can be very confusing. The right solicitor should be someone who will be reliable and trustworthy when handling your claim.

Obviously you are free to choose whoever you wish to represent you and should never feel pressurised into instructing somebody just because they were recommended by insurers or any other organisation.

It is worth noting there is no legal requirement to instruct a Solicitor to handle your claim. However should you choose to instruct, there are a number of factors which can affect the success of your case. In particular, knowing the legal arguments to put forward if liability is denied, or if an offer is proposed to you, knowing if it is reasonable.

It is therefore recommended you instruct an experienced Solicitor who will be able to professionally advise you on all aspects of your claim. The following 4 things should be taken into consideration.

Do They Specialise in Personal Injury?

A good way to find out more is to search for an accredited specialist using the Law Society website or the Association of Personal Injury Lawyers (APIL) which lists all the firms who specialise in Personal Injury.

Personal Recommendations

If you know someone who has gone through a personal injury claim, ask for their recommendations and find out how their solicitor was able to help.

Feedback and Reputation

Utilising the internet will allow you to access reviews such as those on Google. It is also worth visiting the firms website to understand the expertise within the team and ensure they have the expertise to handle your particular case.

How Will the Case be Funded?

Most claims are funded by using a Conditional Fee agreement, more commonly known as a No Win No Fee agreement. Under this type of agreement there is no financial risk to you as if you lose the case you do not have to pay anything. If the claim is successful, the other party pays your legal fees. There will be a deduction from your compensation known as a success fee. You will need to check with your Solicitor how the claim will be funded and the amount of the success fee and any other costs. It is important to ask about anything you are unsure about. In some cases, legal expenses may be covered by an existing insurance policy that you have. Your Solicitor will ask you to check this.
